Handwritten responsum to a query in halachah by Harav Shmuel Levi Weinberger, Av Beis Din of Serdheil. The present letter addresses the question of whether it is a transgression of
bal tashchis to cut down a fruit tree whose shade is harmful to a vineyard and causes financial loss to the owner.
Hagaon Harav Shmuel Levi Weinberger (1860-1925), Av Beis Din of Serdheil, was the son of Harav Pinchas Weinberger, author of Shu”t Maharaf Shusburg, and son-in-law of Harav Hillel Lesh of Kolomiya. He studied under the tutelage of his uncle Harav Yehoshua Aharon Tzvi Weinberger, Av Beis Din of Margereten, and Maharam Schick, receiving semichah from the Yitav Lev and Maagalei Tzedek as well as spiritual guidance from the Shinova Gaon. He also served as Av Beis Din in Kerestir, Nigerest and Bania. The vast majority of his writings and responsa were lost in the Holocaust.
